Terms of Service

These terms apply to everyone who uses PlantMyYard: gardeners who receive a plant list, and garden centers, nurseries and landscapers who subscribe. Using the service means agreeing to them.

1 · What PlantMyYard is

PlantMyYard asks about your garden and suggests plants suited to your climate, your light, and the look you asked for. A garden center displays a code, you scan it, you answer some questions, and we email you a list.

It is a starting point for a good garden, put together from horticultural data and a set of rules about what grows where. It is not a survey of your property, and it has never seen your soil.

2 · The plant list is advice, not a guarantee

This section is the important one, so it is written plainly rather than in capitals.

We do not guarantee that any plant will survive. We know your ZIP code and what you told us. We do not know your soil, your drainage, your frost pockets, your deer, the pipe under the lawn, or whether you water in August. Gardens fail for all of those reasons and none of them are visible to us.

Check anything that matters before you plant it. In particular:

  • Toxicity. Many ordinary garden plants are poisonous if eaten, and some are dangerous to cats and dogs in small amounts. Where we know of a risk we mark it, and those marks are compiled from horticultural sources as a convenience — they are not a medical or veterinary opinion, and an unmarked plant is not thereby certified safe. If you have small children or animals, check each plant yourself. The ASPCA’s plant list is a good place to start. In an emergency, call a doctor, a vet, or Poison Control.
  • Local restrictions. Some plants are regulated or prohibited in some states and counties, and the rules change. We take reasonable care to exclude species widely listed as invasive, but we cannot track every local ordinance, and the responsibility for what you plant is yours.
  • Utilities and boundaries. Call 811 before digging. Mature sizes in our lists are estimates; a tree that fits the space on paper may not fit it beside a wall or under a line.

Photographs are illustrative. They show the species or cultivar named, not the individual plant you will be sold, and colour varies with soil, light and season.

We do not promise that any garden center stocks what we suggest, or at what price. We are not the seller and we take no part in that transaction.

3 · Using the service as a gardener

It costs you nothing. Give us an email address you actually use, so the list reaches you. Do not enter someone else’s address.

The list we send is yours — print it, share it, take it to whichever shop you like. What you may not do is copy our plant database wholesale, scrape the service, or resell it as your own.

4 · Subscriptions for garden centers

Trial

New subscriptions begin with a 7-day free trial. No charge is made during the trial. Cancel before it ends and you are never billed.

Billing

Subscriptions are billed in advance, monthly or annually, by Stripe. Annual subscriptions are charged at ten months’ price for twelve months’ service. Prices are in US dollars and exclude any applicable tax.

We may change prices with at least 30 days’ notice by email. A change takes effect at your next renewal, never mid-term.

Automatic renewal

Subscriptions renew automatically until you cancel. A monthly subscription renews every month and a yearly subscription every year, each at the price shown when you signed up, charged to the card on file on the renewal date. The term does not lengthen on renewal — a monthly plan stays monthly.

If you started on a free trial, the first charge is taken when the trial ends, at the plan price you chose, unless you cancel before then.

For yearly subscriptions we will email you a reminder between 25 and 40 days before each renewal, telling you what is about to be charged and how to stop it.

Cancelling

Cancel at any time, in one step, from the billing portal — the link is in every invoice and receipt we send. You do not need to call anyone, and nobody will try to talk you out of it. If you would rather just write to us, email hello@plantmyyard.com and we will action it within one business day.

Your subscription then runs to the end of the period you have already paid for and does not renew. We do not refund part-used periods, except where the law requires it or where we have plainly failed to provide the service.

Fair use

Each plan lists a monthly number of customers. We will not cut a customer off mid-flow because a plan ran out. If you consistently exceed your plan we will contact you about moving up a tier; we will not silently break the thing your customers are standing in front of.

Your name on the list

By subscribing you allow us to put your business name and logo on the plant lists we send to your customers, and to name you as a nearby garden center to gardeners who use PlantMyYard on their own. You keep every right in your name and logo, and this permission ends when your subscription does.

Suspension

We may suspend an account for non-payment, or for use that harms the service or its users. Where we can, we will tell you first.

5 · What we own, and what you own

The software, the plant database, the design rules and the photographs are ours. You may use them through the service; you may not extract, copy or resell them.

Your business name and logo remain yours. A gardener’s own plant list is theirs.

6 · Availability

We aim to keep the service running and make no promise that it never stops. Maintenance, outages at our hosting providers, and faults will happen. If the service is unavailable for a prolonged period we will make it right on the subscription rather than argue about it.

7 · Limits on our liability

To the extent the law allows: we are not liable for plants that fail, for garden work undertaken on the strength of a list, for lost profits, or for indirect or consequential loss. Our total liability to a subscriber for any claim is limited to the amount that subscriber paid us in the twelve months before the claim. For a gardener, who pays us nothing, our liability is limited to re-sending the list.

Nothing here excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.

8 · Changes to these terms

We may update these terms. Material changes will be emailed to subscribers at least 30 days ahead. Continuing to use the service after a change means accepting it.

9 · Governing law

These terms are governed by the laws of the State of Colorado, and the courts of that state have exclusive jurisdiction.
